  1. Scope of application

All commercial operations carried out by our Company are subject to the present general terms and conditions of sale (hereinafter referred to as the "General Terms and Conditions") which govern the contractual relations between any user of the https://www.lattachante.fr website (hereinafter referred to as the "Website") wishing to make a purchase via the Website (hereinafter referred to as the "Client") and the PRECIS DEC SAS company, whose head office is located at ZA La Cibole 72 400 La Chapelle Du Bois FRANCE and registered in the LE MANS Trade and Companies Register under the number 412 656 787 (hereinafter referred to as the "Precis Dec").

PRECIS DEC may modify some of the provisions of these General Terms and Conditions of Sale at any time. Consequently, it is necessary to read the version in force on the day of the order on the Site. These modifications are enforceable as of the date they are posted online and will be applied to orders placed after their posting on the Site.

Any purchase on the Site is subject to all the clauses of the General Conditions. The Customer may only validate his order after having duly read the General Conditions. By validating the General Conditions, the Customer declares that he/she has the legal capacity to enter into a contract within the meaning of articles 1123 and following of the French Civil Code.

For the understanding of the General Conditions, the following terms should be defined:

  • "CUSTOMER": means the Seller's co-contractor, who guarantees to have the quality of consumer as defined by French law and jurisprudence. In this respect, it is expressly provided that the Customer is acting outside of any usual or commercial activity.

Professionals should contact the Seller's sales department in order to benefit from different contractual conditions

  • "DELIVERY": means the first presentation of the Products ordered by the Client at the delivery address indicated at the time of the order.
  • "PRODUCTS": refers to all products available on the site.
  • "TERRITORY": means the various countries for which the Seller accepts delivery.
  • Products

THE PRODUCTS SOLD

The products offered for sale by PRECIS DEC on the Site (hereinafter the "Products") are described on the Site. They will be the subject of an individual product sheet which will present at least the essential characteristics of the product. The characteristics shall be indicative. The products will also be presented in photos, without contractual value. PRECIS DEC may also offer "Promotions": the products concerned (in terms of price or any other characteristic such as delivery, quantity, etc.) will be sold for a limited period and/or quantity.

  • How to order

To place an order on the Site for the purchase of a Product, the CUSTOMER must:
- be at least 18 years old and have legal capacity or, if he/she is a minor, be able to prove the agreement of his/her legal representatives

- have a User Account opened in compliance with the article on data confidentiality

- be the holder of a valid bank card

The CUSTOMER will be asked to provide identifying information by completing a form available on the SITE. The sign (*) indicates mandatory fields that must be filled in for the CLIENT's order to be processed by the SELLER.

The information that the CUSTOMER provides to the SELLER must be complete, accurate and up to date, particularly when creating an account or placing orders.

The SELLER reserves the right to ask the CUSTOMER to confirm, by any appropriate means, his identity, eligibility and the information provided.

Orders are placed exclusively on the Internet in the following steps:

  •  The Customer fills his basket with Products,
  •  The Customer creates an account or registers if he/she is already a member of the L'ATTACHANTE community,
  •  The Customer provides information about his or her delivery details,
  •  The Customer is informed of the delivery method and the amount of the delivery costs,
  •  The Customer chooses the method of payment,
  •  The Customer validates the General Conditions and his order,
  •  The Customer is redirected to a page of our partner Crédit du Nord (Clic & Pay), and makes a payment request,
  •  Finally, the Customer receives an e-mail validating the order.

The Client is responsible for verifying the completeness and truthfulness of the information provided to PRECIS DEC at the time of the order, particularly the delivery address. The order validation e-mail signifies PRECIS DEC's acceptance of the Client's order and thus forms the sales contract between the parties in accordance with the provisions of the General Conditions. The information provided by the Client and the General Conditions form the contract between the Client and PRECIS DEC and will be included in the order validation e-mail. The Client is responsible for keeping this validation e-mail, which is his/her copy of the sales contract. PRECIS DEC cannot be held responsible for the fact that this e-mail is deleted by an "anti-SPAM" device. The Client may access the contents of his order at any time by logging on to the Site and opening the "My Account" tab. The General Conditions can be consulted from any page of the Site.

  • Availability

Within the framework of a classic sale of a Product from the collection, the Internet user may order any product listed in the permanent catalogue. Only the confirmation sent by PRECIS DEC when the order is placed can guarantee the availability of the product. If the Product is not available after the order has been placed, the Customer will be informed by e-mail or by telephone of the delivery of a partial order or of the cancellation of the order.

  • Awards

The sale prices of the Products offered on the Site in the Sales Sessions are indicated in Euros and increased with the VAT rate applicable on the day of the order.

Price to be paid: The price to be paid is the price indicated on the Site in the Product sheet, increased by the ancillary costs (in particular delivery costs and service options) communicated at the time of the order. It may be reduced by a discount (for example, promotional codes or vouchers). The price will not be final until the order is confirmed. All prices are displayed on our Site in Euros and include all taxes ("TTC").

Promotional codes or vouchers: the CUSTOMER may benefit from personal and non-transferable promotional codes or vouchers which they may use when validating their order by entering their reference in the purchase form. It is specified that the promotional codes or vouchers are only valid for the period indicated by the COMPANY to the CUSTOMER.

 Shipping costs: Shipping costs are due with each order placed. The exact amount of the delivery costs depends on the delivery method chosen, the place of delivery of the order and its content. The amount of the delivery costs will be indicated in the basket and will be submitted to the Customer's approval prior to the validation of the basket. In order to obtain an estimate, the Customer may proceed with a simulation of his/her purchases on the Site. In any case, this indication remains an estimate and only the price retained at the time of validation of the basket has contractual value, except in the case of delivery difficulties or special delivery methods that may result in additional costs.

 Discount and VAT: Orders are payable immediately. There will be no discount applied. In the event of a change in the rate of VAT, the price will be automatically modified without any other notice than the legal date on which the new rate becomes due.

Price variations: The prices of the Products appearing on the Site are subject to change. PRECIS DEC reserves the right to modify prices without prior notice, particularly in the event of a labelling error. Subject to the following, the prices appearing at the time of purchase are the prices applicable to that purchase. Although the website has been carefully prepared, it is possible that the prices indicated may contain errors. PRECIS DEC is in no way bound by its offer and reserves the right to cancel the customer's purchase if such an error occurs.

Foreign currencies: Prices are quoted in Euro. If the currency of payment differs from the currency in which the prices appear, the Client's bank will apply its exchange rate in force at the date of purchase, beyond the control of PRECIS DEC.

  • Terms of payment

Once the General Terms and Conditions of Sale have been validated, the CUSTOMER shall proceed with the payment of his/her order by credit card via Clic & Pay, a third party service provider ensuring the security of transactions. The CUSTOMER must have the following debit or credit cards: Carte Bleue®, MasterCard®, VISA®.

The payment of the goods can be made by credit card for the whole Territory. The Customer indicates his details, validates the basket and the total price. He validates his order and is then redirected to a page of our partner Clic & Pay where he provides his credit card information. The reception of a confirmation by PRECIS DEC validates the sale. The sale is then concluded under the suspensive condition of the availability of the product and therefore of the reception of a confirmation sent by PRECIS DEC to the email address indicated by the Internet user during the purchase.

PRECIS DEC retains ownership of the goods sold until delivery of the goods to the customer or to the recipient designated by the customer. Failure to pay by either party may result in the goods being reclaimed. These provisions do not prevent the transfer to the Internet user, upon delivery, of the risks of loss and deterioration of the goods purchased as well as any damage they may cause.

  • Payment security

PRECIS DEC has chosen efficient and rigorous tools in terms of securing payment methods. PRECIS DEC has adopted a banking solution that uses the SSL (Secure Socket Layer) encryption process, one of the most effective security systems available today, which establishes an encrypted connection directly between the Client and the bank.

PRECIS DEC does not have access to confidential information concerning the payment method used by the Client. This is why the Customer's bank details will be requested for each new order. Indeed, only Crédit du Nord (CLIC & Pay) has access to confidential information which remains inaccessible to third parties.

Although PRECIS DEC uses encrypted security software, the security of information and payments transmitted over the Internet or via e-mail cannot be guaranteed. PRECIS DEC shall not be liable for damages resulting from the use of electronic means of communication, including - but not limited to - damages resulting from failure or delay in the transmission of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for electronic communications and transmission of viruses.

  • Delivery

8.1 Terms of delivery

The Products are shipped within the Territory defined in these General Conditions.

Delivery is made by courier or by deliveryman, at the Customer's choice among the delivery methods offered and determined according to the weight and dimensions of the package. The delivery of each product in the basket can be made independently. When placing the order, the Customer must carefully fill in all the fields on the delivery form, including the delivery details and indicate a landline or mobile phone number. Neither PRECIS DEC nor the transport company can be held responsible for the impossibility of delivery due to an imprecision or error in the delivery address.

Deliverer: Delivery may be made by a Delivery Man for large or heavy packages. In this case, the Customer is contacted either by e-mail or by telephone directly by the Deliverer so that they can agree on a delivery appointment (hereinafter, the "Appointment"). At the time of this contact, the Customer must expressly indicate any difficulties of access or passage that the Supplier may encounter during delivery (including if they were previously indicated on the order form).

Courier: smaller or lighter packages can be delivered by courier. The Customer must indicate a delivery address where a natural person can receive the parcel on the first delivery (for example: workplace, home of a friend or family member, caretaker, etc.).

8.2 Delivery times

The delivery times indicated when the order is confirmed are calculated in working days and are specific to each Product. Due to the variety of supply areas, manufacturing and logistical constraints, these times may vary and PRECIS DEC cannot be held responsible.

8.3 Additional charges

In the event that delivery is not possible on the day of the Appointment due to inappropriate information, access or passage difficulties not previously indicated by the Client or the Client's absence from the Appointment in violation of the commitments made during the contact, new delivery costs may be invoiced by PRECIS DEC, which will contact the Client for payment of these new delivery costs before any new delivery of the Product. In the event of non-payment of these charges, PRECIS DEC reserves the right not to deliver the Product. The risks of damage resulting from these constraints will also be borne by the Client.

8.4 Postponement of the delivery date/change of delivery location

If the Client wishes to change the delivery address or postpone the delivery date, he/she must inform PRECIS DEC as soon as possible and no later than seven (7) working days before the planned delivery date. To inform PRECIS DEC, the Client must use the "Contact" section of the Site. The Customer should quote the order number, the Product concerned and indicate his comments justifying the changes. PRECIS DEC will then confirm its acceptance or refusal, with reasons, by e-mail or telephone as soon as possible.

8.5 Receipt of ordered products

At the time of delivery, the Customer must unpack the Product in the presence of the Deliveryman/Courier and check that the Product delivered corresponds to his order and that no damage affects his Product before signing the delivery note. In the event of an anomaly, the Customer must write precisely the nature of his reservations on the delivery note. These reservations must be handwritten, dated, detailed and accompanied by a signature on the delivery slip. The words "damaged product" are, for example, not sufficiently explicit. The Customer must indicate the nature of the damage: scratches, dents, stains, etc. Similarly, if a delivery error is found, the Customer must specify the nature of the error: wrong colour, wrong reference, wrong quantity etc.

In the event of an error or damage, the Customer must refuse the Product and send us his/her reservations within five (5) days by e-mail via the "Contact" section of the Site and simultaneously by registered letter with acknowledgement of receipt to the address indicated below PRECIS DEC ZA La Cibole 72 400 La Chapelle Du Bois FRANCE

Any complaint sent after these deadlines cannot be accepted. If the Client does not express any reservations, the Product delivered is deemed to be satisfactory and may not be contested at a later date. For example, the Customer may not make any reservations either to PRECIS DEC or to the Deliverer/Courier, after the departure of the Deliverer/Courier, even if the package has not been opened in the presence of the latter.

Except for cases of lack of conformity or hidden defects, no claim and/or reservation will be accepted by PRECIS DEC, after receipt of the Products by the Client, if the latter has not complied with the procedure described above.

  • Cancellation Returns and Right of Withdrawal

CANCELLATION

The Customer may cancel any order for products, without giving any reason, provided it has not already been dispatched.

To request an order cancellation, the Client should contact PRECIS DEC by e-mail via the "Contact" section of the Site.

RETRACTION

The Customer has 14 (fourteen) working days from receipt of the goods to return the order for any reason. In application of Belgian law, Belgian Customers have a period of fifteen (15) days to exercise this right. In the event of retraction, all return costs will be borne by the customer. This period is calculated in working days: if the period expires on a Saturday, Sunday or public holiday, the period is extended until the first working day following midnight. In order to facilitate the handling of the Client's request for withdrawal, it is possible to send such a request to PRECIS DEC through the "Contact" section available to the Client on the Site.

The procedures for exercising the right of withdrawal are as follows:

For fragile Products, delivered via a delivery service or by courier, the Customer must contact PRECIS DEC in order to organise the return of the Product. For a return from the home, the delivery person will make an appointment with the Customer and will check at his home that the Product is in new condition and in its original packaging. The Product must not bear any traces of use and must be accompanied by its accessories and any instructions for use or assembly. If these conditions are met, the Supplier will take back the Product.

PRECIS DEC will carry out a quality control of the Product at the company. The Products must be in new condition, in their original packaging, without any trace of use, and accompanied by their accessories and any instructions for use or assembly. PRECIS DEC will only proceed to reimburse the sums received for the returned Products once it has checked that these conditions have been met. If the conditions mentioned above are not met, the Client's refund will be reduced by the amount corresponding to the loss of value of the Product, as determined during the inspection.

Once the Products have been returned in accordance with the procedure described above, the refund (not including the initial shipping costs of the Product) will be made within a maximum of thirty (30) days from the date of receipt by PRECIS DEC of the returned Products. After this period, interest will be charged at the legal rate. The return costs are always at the Client's expense. Throughout the procedure, the Customer will be informed by e-mail of the receipt of his/her wish to withdraw, the return of his/her package and the date of reimbursement.

  1. Hidden defects

PRECIS DEC guarantees the Client against all consequences of hidden defects that may affect the Products sold, unless otherwise stated on the Web Site in accordance with French law.

The guarantee for hidden defects only applies if the Internet user proves that the defect he/she has noticed already existed before PRECIS DEC delivered the product. It is the responsibility of the Internet user to have the product appraised at his own expense to obtain proof of the existence of the hidden defect.

PRECIS DEC's liability shall never exceed the value of the item in question. Furthermore, no other compensation may be claimed by the Internet user apart from those expressly provided for by the Consumer Code.

  1. Intellectual Property

L'ATTACHANTE is a protected trademark registered at the INPI as well as its logo and https://www.lattachante.fr is a domain name also protected. They are the exclusive property of PRECIS DEC and cannot be used without our prior agreement. Any link with other sites without the prior agreement of PRECIS DEC is strictly forbidden.

The graphic and editorial elements presented on the Site are the property of PRECIS DEC and are protected by copyright. The presentation of the products (photographs, videos, drawings, product sheets, etc.), whether they are for sale or not, are also the property of PRECIS DEC or its partners (designers, suppliers, etc.) and may not be reproduced without the express authorisation of their respective owners. Any copy or reproduction, any use of all or part of our graphic and/or editorial elements or of any presentation of our products is strictly forbidden and constitutes an infringement of our intellectual property rights which will be prosecuted and sanctioned as such.

  1. Privacy

In application of law n°78-17 of 6 January 1978, it is recalled that the nominative data requested from the buyer is necessary for the processing of his order.

As the personal data requested from the buyer is necessary for the processing of the order, PRECIS DEC undertakes to use the confidential information of its Internet users only in the context of the operation of its Site. Within the framework of partnerships, PRECIS DEC may rent, sell or use its customer file in partnership with other companies. The use of the contact information of the Clients/Members will therefore be made in accordance with the expression of their preferences at the time of registration.

At the first request of the Internet user who no longer wishes to be included in the PRECIS DEC database, we undertake to deactivate all contact details and information relating to the member concerned.

PRECIS DEC may use technical means to obtain non-personal information about users in order to improve the functionality of the site, for example by tracking the number of visitors to the site.

Furthermore, PRECIS DEC only collects personal data such as name, first name, address and e-mail address if these are given voluntarily by the visitor. The data collected in this way may not be used for any commercial purposes other than those mentioned on the site or which may be developed later by PRECIS DEC.

None of the information may be transferred to third parties without the express agreement of the member at the time of registration or subsequently in the data management area. Each member has the right to access, modify, rectify or delete data concerning him/her (Article 34 of the French Data Protection Act). To exercise this right, they should contact PRECIS DEC by sending an e-mail to contact@lattachante.fr or, at any time, by modifying their data in "My account".

  1. Litigation and Liability

The Client is responsible for verifying the completeness and truthfulness of the information provided to PRECIS DEC at the time of the order, particularly the delivery address. PRECIS DEC cannot be held responsible for any input errors that may cause delivery errors. PRECIS DEC cannot be held responsible for the Client's failure to respect the delivery terms and conditions and the appointment that he/she has set with the carrier. In such cases, the Client will be responsible for any costs incurred for the return and storage of the products. Without limiting the foregoing paragraphs, PRECIS DEC's liability shall not exceed a sum equal to the amounts paid or payable in the transaction that gave rise to said liability, regardless of the cause or form of the action concerned. Are considered as fortuitous event or force majeure exonerating responsibility all facts or circumstances irresistible, unforeseeable and independent of the will of the parties, in particular in case of total or partial strike of transporters, riots, war, pandemic and natural disasters.

The choice and purchase of goods by the Client are his/her sole responsibility. Consequently, the total or partial impossibility of using the Products, notably due to incompatibility of the equipment, shall not give rise to any compensation, reimbursement or liability on the part of PRECIS DEC, except in the case of a proven latent defect, non-conformity, defect or exercise of the right of withdrawal as provided for by the French Consumer Code.

  1. Dispute Resolution

The General Conditions shall be executed and interpreted in accordance with French law. The parties shall seek, before any dispute, an amicable agreement, it being recalled that the latter does not interrupt the time limits for taking action in warranty. Any dispute of any nature or any disagreement relating to the formation or execution of the order, even in the event of recourse to a guarantee or multiple defendants, will, in the absence of an amicable agreement, be under the exclusive jurisdiction of the courts in the jurisdiction of PRECIS DEC's registered office. The jurisdiction of the courts will be in accordance with the rules of the Code of Civil Procedure when the buyer is not a professional.

  1. Language

The General Conditions, orders, correspondence e-mails and the sales contract concluded with the Customer are in French for the Territory.

  1. Severability of clauses

If for any reason one (or more) of the clauses of these General Terms and Conditions of Sale should be declared null and void, unenforceable, invalid, illegal or inapplicable due to a law, a regulation or following a final decision of a competent court, this modification shall not call into question the validity, legality or applicability of the other stipulations of these General Terms and Conditions of Sale and shall not exempt the Internet user from the execution of his contractual obligations.
